ELECTRICITYMONITOR.CO.ZA is owned by Enbaya Trading CC. ELECTRICITYMONITOR.CO.ZA and its affiliates provide their services to you subject to the conditions set out below.

When you visit or shop at the ELECTRICITYMONITOR.CO.ZA website, you are deemed to accept these conditions. ELECTRICITYMONITOR.CO.ZA and its employees and agents accept no responsibility whatsoever for any damages caused by any means howsoever to any person or property upon the delivery, removal, return, installation of goods or for any other reason whatsoever. We do not accept responsibility for time or earnings lost or for any other consequential damages.

8.1 Product Warranty

ELECTRICITYMONITOR.CO.ZA products carry 12 months (one year) manufacturers warranty from date of purchase. If the product has fault in 12 months, the product will be replaced by a new one. Should a new identical product not be available a similar one will be provided. This warranty is limited to manufacturing faults and/or defects only.

Should we find the product has been damaged by user/use the product will not be replaced.

8.1.1 Procedure for Returns in Case of Faulty Product

Should you find something wrong with the product of no fault of user or use in the first 12 months from date of purchase, you need to contact our offices to determine is such fault exists. Should it be established that a fault may exist, you need to return the product as to postal address Postnet Northcliff, Suite 121, Private Bag X17, Weltervreden park, 1715, Johannesburg.

The product must be returned:

a) in its' original packaging with all items included

b) with a copy of initial order and,

c) letter describing fault of device.

Once product arrives our support department will establish if product was not damaged by user. If product carries fault of manufacturing a new product will be send to the same shipping address as initial order.

Should:

a) fault be found to be caused by user or use (in simple words, using the product in ways in which it was not intended and hence damaged), the product will NOT be exchange to a new one.

b) should product arrive without original packaging and all items included, the product will NOT be exhanged for a new one.

c) should the package not include a letter describing fault of product, there can be no assessment of fault and hence, the product will NOT be exhanged for a new one.

9. OUR RIGHTS

We reserve the right to:

9.1 modify or withdraw, temporarily or permanently, the Website, or any part thereof, with or without notice to you and you confirm that we shall not be liable to you, or to any third party, for any modification or withdrawal of the site; and/or

9.2 change these Conditions from time to time, and your continues use of the Website, or any party thereof, following such change, shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately refrain from using this website.

9.3 we will use our reasonable endeavours to maintain the website. The website is subject to change from time to time. You will not be eligible for any compensation because you cannot use any part of the website or because of a failure, suspension or withdrawal of all or any part of the website due to circumstances beyond our control.

10. APPLICABLE LAW

The conditions and terms of use will be exclusively governed by and construed in accordance with the laws of the Republic of South Africa, whose courts in Johannesburg will have exclusive jurisdiction in the event of any dispute arising, subject to the proviso that we have the right, at our sole discretion, to commence and pursue proceedings in alternative jurisdictions.

11. DESCRIPTION OF GOODS

In view of the extensive range of products sold by us, it is not practical to publish detailed specifications of our products. All images, descriptive matter, specifications and advertising on our sire are provided for the sole purpose of giving an approximate description of the goods. Full detailed specifications are available from us upon request.

12. AVAILABILITY OF GOODS

All products and services are subject to availability and may be withdrawn at any time. If we do not supply the goods for nay reason, you will not be charged for same and we will refund any money already paid in respect of any such goods not being supplied. We, however, will not be responsible for compensating you for any other losses, of any nature whatsoever, which you may suffer if we do not supply the goods.

13. PRICES

13.1 Although we will use our best efforts to ensure that the prices reflected on our website are accurate and current, because of the nature of the goods, prices change and are subject to change without notice. In the event that the price to be charged is more than the price reflected on the website, in respect of any goods, we will advise you thereof, by e-mail, prior to delivery thereof, thus giving you the opportunity to accept or reject any higher price. E-mails sent to you, but not responded to within 7 (SEVEN) days of us sending the e-mail, will be deemed to be acceptance of the higher price.

13.2 All transactions will be processed in South African Rands (ZAR).

14. PAYMENT

14.1 Payment for orders is required via credit card, EFT or via direct deposit into our bank account. In so far as direct deposits are concerned, we do NOT accept cheques, only cash.

14.2 Banking details shall be provided upon the completion of the order, however, should they be required, please e-mail us in this respect.

14.3 All Credit Card payments shall require the signature of the cardholder upon delivery of the goods or else the goods shall not be released. We shall only deliver to the cardholder. All fraudulent attempts shall be handed over to our private investigating unit.

14.4 Once an order has been placed, your order shall remain Pending until: we received proof of paymet (credit card payment will confirm automatically) 2. stock availability has been confirmed. If the item is in stock, you may expect to receive your order within the time period stipulated on the relevant product flyer page.

14.5 For cancellation of orders once payment has been made, a 20% handling fee will be charged upon refund.

14.6 For EFT payments and direct deposits, orders shall only be processed upon actual receipt of payment. You may e-mail or fax us proof of payment or fax to 086 578 1851.

14.7 If you want to change a product to another item after the item left via courier, in addition to any difference in price should any be applicable, you will be charged for courier fees for the first shippment to you and back to us and for the second shippment to you for the new item.

14.7.1 Should the item indicate free shipping and you wish to change the item to a another item; in addition to any difference in price should any be applicable, if the item left via courier already you will be charged for the shipping costs to you and back to us, while the new item will be shipped to you free of charge.

15. DELIVERY

15.1 If ELECTRICITYMONITOR.CO.ZA has stock available, orders will be dispatched within the time period stipulated on the relevant product flyer page.

15.2 Should the goods not be available, you must allow 10 (TEN) working days for delivery, including freight transit time, as required.

15.3 All orders placed on weekends and public holidays shall only be processed on the following working day.

Should we not supply you with the goods, due to any fault of our own, we will not charge you for these, and will refund any money already paid for the undelivered goods. Should non-delivery be due to your fault, such as an incorrect address being supplied to us, you will be liable for additional charges, including delivery charges.

In the event of your placing an order for an incorrect or inappropriate product, then you shall bear the costs of returning the product to us, together with any courier charges incurred in sending the correct product to you. In such instances, we charge the courier fees as described above.

15.6 Take notice that risk shall pass to you once the goods have left our premises.

RETURNS POLICY

You can cancel this order within two weeks after we have received it. You can return new, unopened items from a cancelled order within 2 weeks after they have been delivered to you. Items should be returned in their original packaging.

16. SECURITY POLICY

Virtual Card Services process all credit card transactions. All credit card transactions are 128 bit Secure Socket Layers (SSL) encrypted. The company registration documents and the site's registered domain name are checked and verified by Thawte, ensuring the cardholder and merchant that nobody can impersonate VCS to obtain confidential information.

16.2 Virtual Card Services is committed to providing secure online services. All encryption complies with international standards. Encryption is used to protect the transmission of personal information when completing online transactions. VCS internet servers are protected by firewalls and intrusion detection systems.

16.3 The merchant does not have access to credit details.

16.4 VCS continually reviews and enhances its security in line with technological changes.
